CRIMINAL COMPLAINTS
A criminal complaint is a formal accusation made against a person or entity alleging that they have committed a criminal offense. Criminal proceedings in India are governed by the Criminal Procedure Code, 1973 (CrPC) and the Indian Penal Code, 1860 (IPC).

Types of Criminal Complaints
First Information Report (FIR)
An FIR is a written document prepared by the police when they receive information about the commission of a cognizable offense. A cognizable offense is one where the police can arrest without a warrant and investigate without court permission.
Key Features of FIR:
- Can be lodged by the victim, witness, or any person having knowledge of the offense
- Must be registered immediately by the police officer in charge
- Police are legally bound to register FIR for cognizable offenses
- Investigation begins after FIR registration
- FIR copy must be provided to the complainant free of cost
Process of FIR Registration:
- Visit the police station having jurisdiction over the area where the offense occurred
- Provide oral or written information about the offense
- Police officer records the information in writing
- Complainant signs the FIR after reading or having it read to them
- Police begin investigation and may arrest the accused if necessary
- After investigation, police file charge sheet or closure report
Private Complaint
A private complaint is filed directly in the court when the offense is non-cognizable (police cannot arrest without warrant) or when the police refuse to register an FIR. The complainant approaches the magistrate directly with a written complaint.
When to File Private Complaint:
- For non-cognizable offenses (like defamation, simple hurt)
- When police refuse to register FIR without valid reason

Process of Private Complaint:
- Draft a written complaint with all facts and evidence
- File complaint in the court of appropriate magistrate
- Court examines the complaint and may order investigation

A. Civil Suits vs. Criminal Cases
Civil Cases:

Criminal Cases:

B. Burden of Proof
Civil Cases:

"Beyond a reasonable doubt" - The prosecution must prove guilt to the highest degree. Much higher standard of proof required.
